Terms and Conditions

These “General Terms and Conditions" govern the relationship between Obichka, on the one hand, and on the other hand – the customers of the e-shop with the domain www.obichka.com, who use the products and services provided on the site.

By clicking on an object, image, link (other than the Terms of Use) or button located on www.obichka. com, you are deemed to accept or agree to the "Terms of Use" described below. 

Through the use of the website www.obichka. com, its content, as well as the services offered to it, the user is solely responsible for all consequences arising from this use. The user is liable for any material, intellectual, electronic or any other damages caused to the www.obichka.com website, its content and services, as well as by any other person with whom Obichka has concluded a contract for joint activity or for the provision of services according to European legislation.

All content, including, but not limited to, static images, dynamic images, text and/or multimedia content, published on the Website is the property of Obichka or third parties, in which case the content may be accompanied by a reference to its ownership, for which Obichka has permission to use.

User may not copy, transfer, modify or otherwise alter, use, link to, display, incorporate any Content in any context other than that of Obichka, including any Content from the Website outside of Obichka, removing images, marks, distribution of materials prepared for reproduction, modification or display of Content, without the express consent of Obichka.

Any content that the user accesses or receives is protected by this document, unless the content is accompanied by a specific and duly issued consent for use between Obichka and the user, another party or there is an express reference by Obichka to the content in question for its use.

Obichka accepts no liability whatsoever in the event that the user is misled by third parties claiming to represent the interests of Obichka. The User is obliged to inform Obichka in the event of such attempts using the available contact forms.

REGISTRATION, ORDER, DELIVERY, PRICE AND PAYMENT METHODS

1. Order

Ordering through the online store www.obichka.com can be done 24 hours a day, including weekends and public holidays.

It is not necessary to register on the site to proceed with the order of an item. You can also shop with us as a guest. If you wish to shop with us in the future, Obichka recommends that you register on the site. By registering on the site, you will be able to track previous jewelry orders as well as save shipping addresses. 

The items offered on the Obichka website correspond to the photographic images, with minor deviations being possible as a result of the capture, resolution and screen size of the electronic device from which the customer places the order.

There may be slight variations in the weights indicated on the site, as each item is unique and only one item of a given see jewel is weighed for site purposes.

After finalizing the order, Obichka employees process and confirm the availability of the respective item. The order is processed the next working day after finalization by the customer. Obichka contacts the customer at the email address provided by the customer to confirm the order received and confirm the shipment of the item.

It is possible that the ordered items may be out of stock, so after finalizing the order the customer will receive a confirmation from Obichka to proceed to delivery. In the event that the requested items are not available, Obichka undertakes to refund any amounts previously paid within 3 days of the date of payment.

Obichka reserves the right to accept or decline orders as necessary.

Once the customer confirms the amount of the order and Obichka informs the customer about the validity of the order, it is subject to the terms and conditions of the Distance Selling Contracts regulated in the current European legislation.

2. Register

Initial registration on the site is made once in the "Create an account" section, and the data marked with an asterisk are required.

When registering, the customer enters a shipping address, first and last name, email and contact phone number. The customer also notes a username and password, which will identify him/her for subsequent orders and login to the Obichka system.

After initial registration, each subsequent order and/or login to the Obichka system allows the customer to change the personal delivery information originally entered, such as contact phone number, delivery address and/or billing.

When ordering again through the online store Obichka, as well as a separate login to the site system, it is sufficient for the customer to identify himself only by entering a username and password in the section provided for this on the site. After registration, from his personal profile the customer can monitor and check the status of his current order, the selected goods, their quantity and final price. From there, the customer can place the order, add or delete items from their profile by selecting the appropriate buttons.

From their personal profile, the customer can check the status of all their previous orders.

3. Prices

The prices of the items in the online store Obichka are final.

The delivery price is fixed.

Delivery is at the customer's expense. 

For orders over 60 EUR the delivery is at the expense of Obichka.

When finalizing the order, the customer sees the total he has to pay for the selected product along with the included shipping.

4. Payment methods

The customer chooses the payment method from the payment options provided on the website. 

The payment methods are as follows: 

• Payment with credit/debit card - Visa, Mastercard, American Express or Discover

If the credit card transaction is approved, the amount will be reserved immediately and you will receive an order confirmation to your email/phone number. If the transaction is not approved, your order will be canceled. Please contact your bank or card provider if you have any questions about this issue.

Please note that Obichka guarantees that your details are completely safe with us and all transactions are encrypted. Keeping your online payments secure is our main priority. That means you might need to verify your card payment with 3D Secure authorization to complete your transaction. Contact your bank to learn more about 3D Secure authentication.

• Payment with PayPal

If you select PayPal payment method during checkout, at the end of the ordering process you will be directed to PayPal. If you are already a PayPal customer, you can log in with your user data and confirm the payment. 

Once the incoming payment is registered with us, your order will be processed. The payments are usually confirmed within a few minutes.

5. Delivery

After order processing and payment confirmation, the order is considered accepted and the delivery period starts. All prices, terms and conditions of delivery are specified at the order confirmation stage and the latter remain valid or are described here: (active link to Shipping Policy)

Delivery is made to the address indicated and confirmed by the customer. Exceptions are Sundays and public holidays when deliveries are not made. Delivery times are determined by the serving courier company in the respective country.

The details of the order, including but not limited to the time required for delivery, are not a contractual obligation of the Customer and neither party shall be liable for any damage caused by the delivery to either party.

In the event that the requested address is not attended and the customer does not respond to calls from the courier service, the delivery is returned to the office of Obichka. If the customer does not request re-delivery within 7 (seven) working days after the product has been returned to Obichka's office, the order will be cancelled and the money will be returned to the customer's account within 30 days. Only the flat fee for the non-delivery will be deducted from the amount. The delivery time depends on the destination.

BASIC RIGHTS AND OBLIGATIONS OF EACH PARTY

1. Rights and Obligations of Obichka:

Obichka undertakes to ensure the continued operation of the website as far as this is possible in the circumstances beyond Obichka's control. Obichka shall not be liable for failure to provide the services in the event of force majeure beyond Obichka's control, or problems due to the customer's equipment.

Obichka has the right to send messages to registered users and to place on its pages any advertising banners and announcements about goods and services on the site, including those that link to other websites. Obichka is not responsible for the accuracy or legality of such sites.

If the selected items are not available or a problem with delivery occurs in the event of force majeure beyond Obichka's control, Obichka undertakes to refund all amounts previously paid within 7 days of the date on which the customer made payment for the actuule.

2. Rights and obligations of the Customer:

The Customer is obliged not to provide his/her username and password for the Site to third parties, as he/she is considered the owner of any order placed through the Site.

The Customer is obliged not to carry out actions or omissions directed against the normal functioning of the site, the normal operation of other Internet users, as well as any actions leading to a violation of Internet ethics.

The customer may return the order within 14 days from the date of delivery. The condition for the return is that the item has no signs of use, is not damaged in a commercial manner and is in its original packaging. Refunds will be given in the same form of payment originally used for purchase.  

Refunds will be issued to the original purchaser.

At any time, the customer may request that his/her user account be deleted from the Obichka website, together with the associated data. For this purpose, he must send a message of his wish to the site administration at info@obichka.com, using the email from which he registered on the site.

At the time of registration, the client is obliged to provide correct data, as well as to allow the administration of Obichka to verify their authenticity by phone call or email to confirm the authenticity of the information.

INFORMATION STORAGE AND DATA PROTECTION

The Customer consents to Obichka storing information or accessing information stored on the Customer's end device – cookies.

The purposes of storing the information provided are as follows: customer identification when logging in and using the site; accessing and changing personal data and settings when using the site; creating, maintaining, reviewing and archiving past and current orders.

The purposes of the processing of the information provided are as follows: prevention of misuse of customer identification when logging in and using the site; improvement of the services provided by Obichka; statistical information on purchases, attendance and presence on the site.

Obichka provides users with the possibility to obtain information about the data stored on the end device at any time – cookies.

Obichka also has the right to subsequently store information or gain access to information in the event that the customer has not objected.

In order to use the services subject to these General Terms and Conditions, the customer provides his/her personal data and Obichka undertakes to use this information only for the purpose of fulfilling the request made by the customer.

The information provided by the customer is not presented or sold to third parties.

Obichka may use personal information provided by the customer, such as first and last name, physical and/or e-mail address for direct marketing purposes only. In these cases, the customer may exercise his/her right to opt-out of receiving advertising messages by requesting this at the email address indicated on the contact page of the website.

In all matters not covered by these "General Terms and Conditions", the provisions of the current legislation of the European Union shall apply.

Obichka reserves the right to unilaterally modify these Terms and Conditions. Changes made shall be brought to the attention of customers by posting them on the website.
